Repayment of tax on overpaid wages

in Personal Tax
My employer overpaid me for 3 years (£9000 inc tax), I don't mind paying the money that I received back but my employer is insisting I also pay the tax. There's a thread on this website that mentions an old British rail case where a tribunal determined it to be unlawful for an employee to pay back tax on overpaid wages, does anyone know the name of this case?
