I have just been given 2 p45's by a new employee
1 is dated 03/07/06 and has a 503L tax code and figure payed to date the 2nd is dated 28/01/2007 with a code of BR and £1000 pay to date £220 tax to date.
Can I use the old P45 or do I have to take the most recent P45 figures and code
I was studying this last night and this didn't come up but I have a feeling I can only use the most recent P45

You are correct you can only use the most recent P450 -

I decided to ignore both P45s and give the person a P46 to complete.

Sorry Jackie I'm a bit worried that you've done that as the latest P45 shows BR tax.
If you have used the emergency tax code then you could be under taxing this employee.

Definately use the most recent P45. P46 is for when they don't give you a P45! You can phone Inland Revenue too - they are very helpful with any queries you have and don't keep you waiting on the phone long either.
