Donation to a school

I have a sole trader client who wants to donate £500 for sports equipment I think, to the school his partner works at, and as far as I am aware the school does not have charitable status.

As far as I was aware the donation wouldn't be tax allowable but my client has been told it would be. I'm having difficulty finding the info on HMRC and have consulted my ATT study literature but can't find a definite yes or no. I've also looked in the Tolleys tax guide but can only find that it would be allowed if it was a gift of trading stock to a registered amateur sports clubs; if it was a contribution to a local enterprise organisation; or if it was a donation to a charity but I'm not 100% sure about this one.

I know I can call HMRC but just wondered if anyone could put me on the right track, I'm just back off holiday and haven't got time to hang on the phone forever waiting for an HMRC advisor.

    Sole traders can claim tax relief on donations to local charities, but not to national ones, I believe.

    If it's not a charity... get them to put something printed somewhere with the business name and call it advertising.

    Not sure if he'd get away with advertising his services at a school. lol

    Possibly not! But maybe if pitched to the staff/ parents?

    If he's not getting advertising in return, I don't think he can claim it as tax deductible.

    That was my train of thought until he said he'd been told by someone else it was.

    Suppose I'll have to call HMRC but I know that they'll say I'll have to speak to a technical advisor and that there won't be one available. It'll be the usual, 'we'll get someone to call you back' and I'll still be waiting for the call in 2 weeks time!!

    Don't bother. Get a subscription to a tax helpline and ask them instead. Are you a MIP yet? If you are, you get a free helpline included.

    Unfortunately I still haven't finished my project, I'm goona get back to onto it at the weekend, it's the only thing stopping me sending my MIP application in as I've already got tprovisional membership.

    Nope, I'm just acutely aware of how I'd be 4 years qualified instead of 2 if I'd have gotten that darn report completed earlier! :lol:

    No, I use the free AAT one. Have a look at the Tax Club. We are members but don't know what it includes, might be a helpline with it. Membership is only £100+vat a year.

    Well I did finally got through to HMRC's technical team who said if it was advertisibg his business, regardless of what his treade was then it is allowable as an advertising expense.

    Can't say I feel reassured.

    Glad you got a response.

    Is he actually advertising though? I thought that was the sticking point
