Temporary staff holiday pay

My HR department want to change the way we pay temps by adding thr 12.07% holiday pay to their hours and roll up their hourly rate to include it. I have said this is against the law and we have to ensure they take holidays. Can anyone point me in the right direction for some current legislation on this please.

I add 12.07% to our term time only staff (paid for 39 weeks spread into 12 equal portions) but different circumstances, we got the rate from direct.gov0
