Hello,

Does anybody know if HMRC will fine you, if you set up as a new employer more than 1 month after paying the employee? I have a client who has been paying someone since February, but she hasn't set up as a new employer yet. The PAYE liability isn't huge, in the two months it totals £158.05 and there is only one employee.
I am thinking that the best thing to do is set her up asap (it is a company), put the first pay date as 28.02.13 and just make sure the PAYE is all paid by 19.04.13. Is this the best thing to do??

Hope that makes sense

Many thanks for looking

Nicola

I don't think they will fine you.

A client I took over from another accountant had been paying an employee and the old accountant said they had applied for a PAYE scheme but never received anything. The employee then left anyway. I reapplied for a PAYE scheme and submitted the details of the earlier pay, paid the tax and NI that was due, and the client was never fined.
