the data protection act..

What would you say was classed as personal data?

Which from the following would be classed as a data user?
Individuals
Organisations
Individuals within organisations

If a data user has given consent would sensitive data be able to be processed?

What would be classed as sensitive data about a specific individual?

Thank you very much for any help you can give me, i dont want to seem as if im just skipping out the research and just asking but i cant seem to find specific regulations anywhere. Ive always just taken the "dont tell anyone anything" approach.

Thanks again
Cheryl

    Re:A few questions????

Theres this link to assist you with really nitty gritty stuff
    http://www.informationcommissioner.gov.uk/eventual.aspx?id=34

    And heres some nice overviews.
    http://www.dataprotectionact.org/
    http://www.scottish-enterprise.com/sedotcom_home/services-to-business/s2b_legal/data_protection.htm

But in response to you individual questions: It applies to all personal data about individuals but not those who are dead(!) or corporations.

Not sure I understand your second question, or know the answer, is any of this relevant:

"Prevent the misuse of personal data by ensuring that it is:

    â?¢ Obtained lawfully
â?¢ Only held for the specified purpose
â?¢ Not used for other purposes
â?¢ Shall not be excessive for purposes
    â?¢ Accurate & kept accurate
â?¢ Not kept beyond the need of the purpose
â?¢ Available to subjects and they are allowed correction and in some cases prevention of processing e.g. direct marketing or where in causes unwarranted damage."[/i]

    Re:A few questions????

For the first question i put organisations and individuals within organisations because i dont really think individuals themselves use much data that would be protected under the data protection act although i could be talking complete rubbish here!
