After nearly three years of employment, a contract with terms and conditions landed on my desk this morning, with a (written) demand that I sign it.
Of course, I decided to read it first (note- I plan on resigning next Wednesday, but I still don't think anyone knows this).

One of the clauses states that the company has the right to search my private property (including private vehicle) at any time when they are on company premesis, and that failure to comply could result in my dismissal.

Is this really a standard clause? My car, backpack and wallet is subject to random inspection by my boss and I have no right to complain?

There's also a clause that bans me from praying on company premises.

Thankfully there's no training agreement, so if they think they're getting the AAT fees off me they've got another think coming.

I have heard about clauses about company's reserving the right to search employees private property in the past - but praying on company premises - well I am sure I can say, with absolute certainty, that is one for the history books! What do you do if your religion demands prayer?

I wouldn't mind the searching clause as much if it had something about ensuring you're not carrying drugs/stolen goods/otherwise illegal items. But it says that this does not imply suspicion, so they're saying it wouldn't be harassment if they insisted on checking my backpack every single day? (they're not, but its the point of the thing)

But the prayer one actually states that no employee is allowed to conduct any religious or political activities on company premises, and goes on to say that this includes campaiging, praying, etc. Or complaining if someone introduces poorly thought out legislation. If Brown gets into power, do you think he'll make an offence of Glorifying the Battle of Culloden?

If your religion demands prayer then it has no place in the company. The MD makes no concessions towards anyone's religion. (Except for himself as an individual- its a Do As I Say, Not As I Do thing)

There's another clause that states I may not take any time off between 15th Dec and 7th Jan, and that this includes working on Christmas Day, Boxing Day and New Years' Day.

Of course, that's contradicted by another clause that states I must take the entire week including Christmas Day as holiday.

I think you'll find that the first is fairly common and has been around for years. As for the second, well I can understand why such a clause would be introduced and companies are allowed to discriminate on religious grounds if a) the point can be proven and b) the rules were made clear to you at the beginning. There is some case law available on the net to show examples of these.

If only one religion was banned that could be classed as unfair discrimination but if all are banned then that's an overrdiding company policy and not aimed at any particular group or sect. We all know that religion is very divisive and can create tensions not wanted in the workplace hence the existence of such a policy. It's not so much religious intolerance as more keeping the peace in a workplace environment where our minds should be on the work we are being paid for. Similarly, many companies also ban politics since that's another hot potato.

If your religion dictates you must pray then you'd have just to try and find a compromise with the employer but as far as I know, they don't have to agree.
