There has been very little in the way of feedback about the increase in holiday entitlement.

How has it been handled where you work?

Is that because they already pay that much holiday?

    It won't affect us either.

The minimum annual leave I've ever known anyone to get (in finance) is 20 days + bank holidays, which makes 28 days so is above the new minimum anyway...

It depends on how your contract is written.

Most are 20 plus bank holidays, so now it will be 24 - plus bank holidays.

Oh ok, I thought the minimum leave an employer legally had to give was including bank holidays i.e. the old 20 was 12 annual leave and 8 bank holis?

It's not my contract - I get 26 days + bank holis - so am not sure what was written in it, it was my friend who worked in an AP dept.

My problem is that our staff get 28 in total, but media has stated an increase by 4 days - and now they want it!

Is that 28 including the bank holidays then?

I might be wrong but my understanding is that the legal minimum of 24 includes bank holis, so your staff are getting 28 - 4 more than the minimum anyway??

I suppose they are thinking 28 is the min. 20 plus 8 bank hols, so they should get 24 + 8 getting 32!

Oh dear! You'll have to set 'em straight and point out they are actually getting 4 more days!

    Good luck! :D

    Show them this:

Will public holidays still count towards statutory annual leave after 1 October 2007?

Yes. So, for example, if from 1 October 2009 a worker gets 20 days per year plus at least 8 public holidays, that will satisfy the minimum entitlement of 28 days.

    Thanks. I've used this one:

    http://www.dti.gov.uk/employment/holidays/index.html

    And this one:

I've thought about asking if they want me to implement the new statutory minimum and then thank them for giving back holiday.

My understanding is that the new increases include bank holidays and when it goes up to 28, all bank holidays will then be taken care of. In effect, employees will have 20 free days to do whatever they want with (even less for those that shutdown at Christmas) since most companies will compulsorily make them take bank holidays out of their holiday allowance.

I personally think the new ruling sucks since for many small businesses that regularly trade on bank holidays - e.g. food outlets that are already struggling to survive - this is an extra cost burden imposed by a meddling government that many of them need like a hole in the head.

    Regards,

    Robert

    Quite right too!

How awful of them to give an extra few days holiday to those who still have only the statutory 20 days (including bank holidays) to contend with.. in the country with the least holidays in Europe. given that your average food outlet manages mark ups of 250-400% whilst often paying minimum wage, the sound your indignant ears cannot perceive might well be my heart bleeding.

Sorry to join in this a bit late, but I've been busy.

Our boss read the literature and said to me - "oh I don't need to pay them for bank holidays or let them have the day off then!" To which I pointed out that it was written in our contracts we are paid for bank holidays and if we work its double time. The way read I it if anybody works BH and are paid dt they are still entitled to a day off as holiday. Haven't plucked up the courage to tell him yet!

The men keep comimg in asking about the extra holidays, have to point out they are already getting 28 days and NOT to mention it to the boss - next thing you know he'll want to change the contracts.
