Can HMRC do this?

Just spent nearly an hour on the phone to HMRC to try and establish why clients refund was half what was expected, and their website only showing "credit transfer out" and no explanation!!!!

It appears that client had underpaid his Class 2 NICS and they had unilaterally decided to take part of his repayment to set against this.

Is this legal?

    Urgh.

    Next they will be stopping payments to off set against VAT nd PAYE!! But I expect there is some small print tucked away that confirms that they can.

    I had similar thing they phone my office and ask if they could off set someones sa tax against overpayed family credit from years ago, I declined and said my client need money desperately at the minute................ they then refunded all moneys

    This was done unilaterally without "asking" anyone at all.....
