Holiday Pay

Can anyone help please? As a school, we pay supply teachers on a daily basis which is calculated as a fraction of the applicable annual rate. Eg £17595 pa/195 teaching days pa = £90 per day worked. A teacher we used recently is now claiming holiday pay on top of her daily rate. Can anyone advise on rolled up holiday pay- I understand that recent talk has been that it should not be used and that holiday pay should be paid on top. Help please!

Holiday Pay
<BR>The Working Time Regulations 1998 give almost every worker the right to four weeks paid holiday per year, or <b>proportionally for part of a year</b>. A full time worker who works 5 days a week will thus be entitled to a minimum of 20 paid days holiday per year (he may of course be entitled to more than this statutory minimum under the terms of his contract).<BR><BR>Rolled-up holiday pay has recently been ruled illegal by a scottish case (I can't remember the name!). The reason being that all employees must have their holiday entitlement to make them effective at work otherwise they will be so tired to make them inefficient resulting in their dismissal!<BR><BR>Hope this helps.<BR>0
